France's parliament has approved an amendment that will subject stablecoin trades to a 31% capital gains tax beginning January 2027. The measure, designated as Amendment I-3898, eliminates the tax deferral that previously applied to stablecoins compliant with the European Union's Markets in Crypto-Assets Regulation (MiCA).

The amendment removes favorable tax treatment for MiCA-compliant stablecoins, meaning traders and investors holding these assets will face capital gains taxation at the standard French rate when they realize profits from transactions. This represents a significant shift in how France treats stablecoin activity compared to the previous regulatory framework. The change will take effect on January 1, 2027, giving market participants roughly two years to adjust to the new tax regime.

Stablecoins are cryptocurrencies designed to maintain a consistent value, typically pegged to a fiat currency like the euro or U.S. dollar. They are widely used in crypto trading for executing transactions, providing liquidity, and settling positions across exchanges. MiCA, which came into effect in December 2023, established the first comprehensive EU regulatory framework for crypto-assets and service providers. Stablecoins that comply with MiCA regulations meet specific reserve and operational requirements set by European authorities.

The 31% tax rate applied to stablecoin capital gains in France reflects the country's standard treatment for speculative financial gains. Previously, the tax deferral for MiCA-compliant stablecoins had created a more favorable tax position than other crypto-assets in France. By removing this deferral, the amendment brings stablecoin transactions into alignment with broader French capital gains taxation policy.

For traders and investors using stablecoins on European exchanges or platforms, this development introduces a new compliance and tax planning consideration. Stablecoins serve as a bridge between traditional finance and crypto markets, and their taxation affects the cost of conducting crypto-to-crypto trades, moving funds between exchanges, and executing hedging strategies. The French measure may influence how market participants structure transactions and manage their portfolios across different asset classes.

The timing of the implementation—more than two years away—suggests that stakeholders including crypto platforms, traders, and institutional market participants have a defined window to understand and prepare for the tax implications. This delay may also provide time for further regulatory clarification or potential industry advocacy regarding the impact on crypto market infrastructure and trading volumes.

Traders and investors with exposure to stablecoin transactions in France should monitor how this amendment is implemented and whether other EU member states adopt similar measures. The outcome could establish a precedent for stablecoin taxation across Europe and may influence how other jurisdictions approach taxation of these instruments. Additionally, market participants should track any guidance issued by French tax authorities regarding calculation, reporting, and compliance procedures for the new 31% capital gains tax on stablecoin trades.
